Terms of service

The sale of products through the marketplace of gasspringseu.es, owned by ELITE SPORTS 17 S.L., is governed by these General Terms and Conditions of Sale. These General Terms and Conditions of Sale are considered accepted without reservations by the buyer. Furthermore, they shall have priority over the general conditions of the buyer. ELITE SPORTS 17 S.L. reserves the right to update the content of these General Terms and Conditions of Sale without prior notice. These conditions replace and nullify all previous ones.

PRICES

  1. The indicated prices may change without prior notice and are only binding if expressly confirmed by GasSpringsEU.
  2. The price does not include transportation costs, taxes (e.g., VAT), or special packaging. Shipments may be made on a prepaid basis with low-cost agencies, with the shipping costs subsequently charged on the invoice. When, by agreement between both parties, the shipping cost is paid, the goods will be shipped by the carrier chosen by GasSpringsEU; any other agency indicated by the customer will be at the buyer's expense.

ORDERS

  1. All orders are subject to the approval of GasSpringsEU.
  2. By placing an order, the customer acknowledges and accepts our General Terms and Conditions of Sale and all the data and technical characteristics of our products detailed in the catalog, including the rates.
  3. Orders are considered firm by the customer when committed under all conditions and cannot be changed or canceled without the written consent of GasSpringsEU.
  4. Confirmed orders are understood as accepted but may be partially or fully canceled by GasSpringsEU due to lack of supply of materials, force majeure, or unforeseen circumstances.

DELIVERIES

  1. Delivery times are indicative and do not bind GasSpringsEU. Delays or partial deliveries cannot lead to the cancellation of the order or claims of any kind for damages and/or suspension of payments by the customer.

SHIPPING

  1. The delivery date refers to the day the goods arrive at the delivery location.

CLAIMS

  1. Claims will not be accepted unless made at the time of receipt of the material or within a maximum of 48 hours, as recognized by law.
  2. In any case, claims for transportation damage must be made in writing on the carrier's delivery note. If the transportation was arranged by the buyer, they must handle the necessary claims.
  3. No material will be accepted for return without prior authorization from GasSpringsEU, and in any case, shipping costs will be borne by the customer. Returns of custom-made products will not be accepted. Used materials will not be accepted for return. Neither will unused materials be accepted for return after six months from the date of sale. In any case, all returned standard series material will be depreciated by 10% of the net invoiced value as a review and adjustment fee.
  4. Claims will not entitle the suspension of agreed payments.
  5. In the event of accepted defects in the product, GasSpringsEU will, at its sole discretion, replace or repair the defective product or its components. Additionally, the customer cannot claim any further damages.
  6. Claims that contradict these General Terms and Conditions of Sale or any specific agreements made in writing will not be accepted. Claims must always be detailed and submitted in writing.

MATERIAL RETURN PROCEDURE

  1. When there is a Non-Conformity or Return by the customer, the following procedure must be followed as long as the goods were not purchased on clearance, are within two years of purchase, and are not discontinued:
  2. Authorization to return any type of material must be requested from the central offices of ELITE SPORTS 17 S.L. by email at info@gasspringseu.es.
  3. It is essential to provide the product reference, quantity, sale date (providing the order number and/or Invoice), and the reason for the return (defect).

Authorization for the return will always be in writing by the office, meaning no acceptance made over the phone or during a sales visit will be considered valid.
Any material returned WITHOUT PRIOR AUTHORIZATION will NOT BE ACCEPTED BY OUR WAREHOUSE and will be automatically rejected. No return will be authorized that does not meet these requirements adequately.

GUARANTEES

  1. Guarantees will comply with the regulations established in the Title referring to "Guarantees and after-sales services" of the Royal Legislative Decree 1/2007, of November 16, approving the revised text of the General Law for the Defense of Consumers and Users and other complementary laws.

JURISDICTION

  1. These conditions shall be governed or interpreted in accordance with Spanish legislation where not expressly established. ELITE SPORTS 17 S.L. and the CUSTOMER agree to submit any disputes arising from the provision of products or services subject to these Conditions to the courts and tribunals of the CUSTOMER’s domicile.
